DENNY ROSE SRL reserves the right to modify and update this document periodically; users are therefore invited to read it carefully before publishing reviews or comments on the website.

DENNY ROSE SRL is pleased to welcome user participation in the content published on the site. The pages of www.dennyrose.it are visible to everyone, and each user therefore remains solely responsible, including legally, for the content they publish.

The space dedicated to users is intended for exchanging advice and publishing product reviews. It cannot be used, without prior written authorization from DENNY ROSE SRL, for commercial purposes, such as the promotion of goods or services, conducting market research, or sending chain messages.

Users are invited to report, through the dedicated channels, content deemed inappropriate or not compliant with the provisions of this document, avoiding improper use of the "Contact Us" function, particularly for irrelevant or defamatory reports.

Registration and personal data

Each user is allowed only one registration. The information in the profile and registration data must be complete, correct, and updated.

It is necessary to use an active and functional email address, both to receive the verification email required to complete registration and to allow DENNY ROSE SRL to contact the user if necessary.

The account is personal. The user is required to carefully guard their access credentials and not to communicate them to third parties. In case of suspected unauthorized use of the account, the user is invited to report it promptly through the assistance channels, to allow DENNY ROSE SRL to intervene.

User privacy is important. It is not permitted to publish confidential information of other users, such as phone numbers, addresses, or other personal data that can be used to contact them.

The website login account is personal. It is not permitted to use other users' accounts, impersonate other users or DENNY ROSE SRL staff members.

It is not permitted to publish material that may generate concern, distress or apprehension in other users, nor content that incites violence or racial, religious or other discrimination.

It is also forbidden to disseminate content through the site:

• in violation of intellectual property rights, including copyrights and trademarks;
• advertising or promotional of products and/or services, including links to other sites or web pages;
• deceptive or suitable to make the user appear as another person;
• suitable to prejudice ongoing legal proceedings of which the user is aware;
• technically harmful, such as computer viruses, trojan horses, worms or other malicious codes;
• contrary to the Terms of Use, Conditions of Sale, Privacy Policy or other instructions published on the site.

It is forbidden to circumvent the protection and security measures adopted for the protection and proper functioning of the site, as well as to republish previously removed content.

DENNY ROSE SRL reserves the right to verify and, at its discretion, publish, modify or delete, in whole or in part, the materials and information entered by users, even if they are not in violation of these regulations.

By publishing content on the website, the user grants DENNY ROSE SRL a non-exclusive, free, worldwide and irrevocable license, for the duration of protection provided by law, to the extent necessary for the management, publication, reproduction, modification, adaptation, translation, communication and distribution of the content through the website and its communication channels.

The user declares to have the necessary rights to grant this license. To the extent permitted by law, the user authorizes DENNY ROSE SRL to use the content even after the cancellation of their account or the removal of the subscription from the site.

If the content published by users is deemed to be in conflict with the rules or in violation of the conditions described on these pages, DENNY ROSE SRL may remove it.

In the event of removal, DENNY ROSE SRL may notify the user of any suspension or closure of the account. It is forbidden to republish content that has already been removed.

Account suspension may be ordered in the event of serious or repeated violations of the Terms of Use, publication instructions, or the rules contained in this document, as well as in the presence of seriously disrespectful conduct towards the community, other users, DENNY ROSE SRL, or its collaborators.

The duration of the suspension will be evaluated in relation to the circumstances of the case and may be applied in particular in the event of repeated violations or conduct of particular seriousness. During the suspension period, it is forbidden to create a new account or use other people's accounts to publish content.

The following text outlines the general terms and conditions applied to every order and purchase of garments and accessories on www.dennyrose.it (hereinafter "website") managed by GAUDÌ TRADE S.p.A., a company with registered office in Italy, Via Nuova Ponente 29, 41012 – Carpi (Modena) (hereinafter "GAUDÌ").

2. 1. Users are asked to carefully read these Terms and Conditions before making a purchase on this website.

3. 1. By confirming the purchase, the user declares:
a. a. Having read, understood, and fully accepted the following Terms and Conditions;
b. a. That the order for products placed on the website is exclusively for personal use and that they do not intend to resell such goods in a commercial or business activity, thus declaring themselves a "final consumer";
c. That GAUDÌ TRADE S.p.A. is authorized to store, process, transfer to third parties and/or abroad the information contained in the online purchase form, so as to enable it to complete the requested order.

4. GAUDÌ will strive to ensure that the information on the website is accurate and up-to-date, although no absolute guarantee can be offered. The user understands and accepts that products may partially differ from the specifications and/or photographs on the website.

5. 1. The following Terms and Conditions cannot be applied if the website contains links and/or banners that lead to the provision of services or the sale of products by parties other than GAUDÌ. In these cases, we advise users to check the Terms and Conditions section on their website before placing an order with these parties. GAUDÌ TRADE S.p.A. will not be responsible for the conclusion of e-commerce transactions between users of our website and third parties.

6. 1. The sales contract is concluded when GAUDÌ TRADE S.p.A. sends written confirmation of the shipment to the email address indicated by the user on the online order form.

7. 1. Should an item appearing in the User's order no longer be available, GAUDÌ TRADE S.p.A. will have no obligation to supply the aforementioned product, but will only be responsible for immediately informing the user of the situation. If warehouse availability is limited to only a part of the products indicated in the order, GAUDÌ TRADE S.p.A. will contact the user to ask if they wish to cancel the order completely or if they only wish to receive the available goods. Obviously, in the latter case, the customer will be refunded the amount for the unavailable goods.

1. The selling currency for all countries is the euro. The amount charged in euros will be the one displayed in the order summary. GAUDÌ TRADE S.p.A. will in any case try to ensure that the prices indicated on the website are always accurate and up-to-date. 9. Shipping costs may differ depending on the country where delivery is requested and will be charged at the time of order placement, according to the shipping rates indicated on the dedicated page. 10. The user must pay the requested amount at the time of order confirmation, in case of payment by credit card or PayPal. If cash on delivery is available in the country from which the order is placed and you decide to use it, we recommend having the exact amount ready to be paid to the courier, including cash on delivery charges. We do not accept credit cards issued in countries other than those of sale.8

11. The courier we have appointed will deliver the shipment to the address indicated by the user on the order and, in the case of a guest checkout, to the address indicated by the user on Paypal or Stripe. 12. GAUDÌ and the appointed transport companies undertake to respect the delivery times indicated on the dedicated page. We wish to inform you that delivery times may vary depending on the country, weather conditions, and/or public holidays. 13. GAUDÌ reserves the right to verify, suspend, or completely cancel, at its own discretion, the fulfillment of any of the obligations arising from the sales contract. This applies if an act of fraud, non-compliance, or a breach of obligations undertaken by the user towards DENNY ROSE Online Store through previous sales contracts is suspected. 14. If customs clearance is required by the destination country, and the User, for any reason, no longer wishes to receive the order once it has reached customs, GAUDÌ TRADE S.p.A. will not issue any refund for the products, which will be abandoned on site.

15. Products purchased on the website can be returned within 14 days from the delivery date.

16. Upon receipt of the goods at GAUDÌ TRADE S.p.A., Via Nuova Ponente, 29, 41012, Carpi, the sales contract is cancelled, and all related obligations, rights, or claims lapse. However, if the products returned by the customer are damaged or do not comply with the return conditions, GAUDÌ TRADE S.p.A. may compensate for this damage by retaining the payment for the products already made by the user. 17. The following conditions are in addition to what has already been indicated in the preceding points (points 15-16):
a. Users who intend to return one or more items must send a request for return authorization via their order summary page within 14 (fourteen) days from the date of their receipt, in order to obtain a Return Merchandise Authorization number ("RMA" or "RAN"). For instructions on how to return a product, please consult the "Returns" section in the customer service area;

b. After receiving the RMA number, products must be sent back to GAUDÌ TRADE S.p.A., Via Nuova Ponente, 29, 41012, Carpi in a single shipment within 14 (fourteen) days from the authorization date;
c. Returned items must be in the same condition as they were received; any damage to the product may entitle the user to a partial refund;
d. The product's identification tag, as well as the single-use seal, are an integral part of the purchased item. Therefore, in case of return, these parts must remain attached to the product and must not have been tampered with;
e. The return of the product will only be accepted if it is contained within its original packaging. Any removable accessories and/or instruction manuals considered an integral part of the item must also be returned along with the item.
f. It is requested to visibly indicate both the recipient, DENNY ROSE Online Store, and the Return Authorization Number (RMA) on the return package to avoid its loss. In case of non-delivery of the returned package, GAUDÌ TRADE S.p.A. will ask the customer for proof of delivery, i.e., the slip bearing the signature of the person who received the returned package. If the customer does not provide proof of delivery, we will not be able to proceed with granting the refund.

18. After checking the integrity of the returned products, GAUDÌ TRADE S.p.A. will confirm to the user by e-mail that the return procedure has been successfully completed and that the refund of the amount for the returned items will be credited, within 30 (thirty) days, to their credit card in case of electronic payment, or in case of cash payment, the amount will be refunded by bank transfer to the current account number that will be requested during the refund process. If the conditions described above are not met during the refund process, GAUDÌ TRADE S.p.A. will not be able to make the refund to the user. However, the user retains the right to collect the items from the DENNY ROSE Online Store warehouse, at their own expense. In the event that the user does not request the return of the items within 30 (thirty) days from the date on which the non-acceptance is communicated

20. In the event of defective products, the warranty exclusively entitles the user to receive a refund equal to the amount paid for the item. The defect must be promptly reported and illustrated to GAUDÌ TRADE S.p.A. via the email address cs@dennyrose.it, in any case no later than 2 (two) months from when it was discovered. Each individual product undergoes careful quality control before shipping. In the event of a return of a defective product, GAUDÌ TRADE S.p.A. will pay the return shipping costs to the company, even for countries where return shipping is normally borne by the customer.
21. Upon return of the product, it will be examined to determine its actual defectiveness. If this is positively acknowledged by DENNY ROSE Online Store, the user will be sent an email accepting the return, which will initiate the refund procedure as already indicated in point 18.
22. With the exception of the aforementioned warranty, GAUDÌ TRADE S.p.A. excludes any other liability towards the user, limited to the applicable mandatory provisions.
23. The price paid by the user at the time of purchase of the product sets the maximum limit of total liability for GAUDÌ TRADE S.p.A. .

24. Should one or more points contained in this document be found to be null, illegal or ineffective, this shall not result in the complete inapplicability of the Terms and Conditions. The points in question shall be amended or replaced in such a way as to take into account their intent and content, while still complying with and pursuant to current regulations.
25. These Terms and Conditions are governed by Italian law, specifically by Legislative Decree 206/05 concerning the Consumer Code, with particular reference to regulations on distance contracts, and by Legislative Decree 70/03 on certain aspects concerning e-commerce.
26. Should disputes arise regarding the following Terms and Conditions between GAUDÌ TRADE S.p.A. and its users, the Judicial Authority identified pursuant to art. 63 of Legislative Decree 206/05 shall have territorial
